Verkhovna Rada registered the bill No.10073 “Amendments to the Criminal Code of Ukraine (concerning the clarification of criminal responsibility issues in the sphere of financial leasing)”.
The draft law envisages the creation of equal competitive conditions for the various sectors of the market in terms of protecting investors and participants against the crimes provided for by the Criminal Code of Ukraine.
The protection of financial leasing market against such manifestations significantly differs from the protection of credit operations carried out by banks and other financial institutions today. At the same time, these operations are essentially identical. It should be noted that banks have the right to conduct the operations of financial leasing. The bill provides the remedy of the situation.
In particular, the draft law envisages the introduction of amendments to the Article 222 of the Criminal Code, which establishes criminal responsibility for the financial resources fraud. It is proposed to create an offence for providing knowingly false information to banks or other lenders in order to obtain the property (including financial lease), in other words the responsibility at the same level as for the crime with the purpose of obtaining a credit.
It is proposed to provide that the waste, disposal, concealment, substitution, damage, destruction leased of assets is a crime by introducing changes to Article 388 of the Criminal Code.
The introduction of these amendments to the Criminal Code will contribute to the prevention of crimes in the economic sphere, which, given the gaps in the law, is widespread in the field of financial leasing now.
